Welcome to Diabetes Intelligence, operated by Key Decision IT ("we", "us", "our"). These Terms of Use ("Terms") govern your access to and use of our blood glucose modeling platform and related services (the "Service").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Who May Use the Service

You must be at least 2 years old to use the Service.

For users under 16, a parent or legal guardian must create and manage the account, provide consent to processing of health data, and supervise usage.

3. Medical and Regulatory Disclaimer

CRITICAL NOTICE

The Service is experimental, for informational and research purposes only. It is not a medical device, is not MDR-approved, and is not intended for diagnosis, treatment, or insulin dosing decisions.

Always seek advice from qualified healthcare professionals. Do not use the Service in emergencies.

  • Do not base insulin dosing solely on outputs from the Service.
  • Verify readings and decisions with authorized medical devices and professionals.
  • We do not provide medical, legal, or professional advice.

4. Accounts and Security

  • Authenticate via Google OAuth. Keep credentials secure and do not share your account.
  • You are responsible for all activity under your account.
  • Notify us promptly of suspected unauthorized access or security issues.

5. Acceptable Use

  • Use the Service only in compliance with applicable EU/UK laws.
  • No reverse engineering, scraping, harmful code, or interference with the Service.
  • No uploading unlawful, infringing, or misleading content.

6. Privacy

Our processing of personal data is described in our Privacy Policy. By using the Service, you acknowledge that we will process personal and special category data as described there, including limited use of analytics and third-party AI APIs.

7. Third-Party Services

The Service integrates with third parties such as Google OAuth, Google Analytics, and AI providers (e.g., OpenAI). Your use of those services may be subject to their terms and policies. We are not responsible for third-party services.

8. Intellectual Property

We retain all rights, title, and interest in and to the Service and its content. You may not copy, modify, distribute, or create derivative works, nor reverse engineer or attempt to extract source code, except as permitted by law.

9. Beta/Research Features

Certain features are provided as beta or research functionality and may change, break, or be withdrawn without notice. They are provided “as is” for evaluation and feedback only.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, reliability, accuracy, or availability. Outputs may be incomplete, incorrect, or delayed.

11. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, or health outcomes, arising out of or related to your use of the Service.

Our aggregate liability for any claims will not exceed the total fees you paid for the Service in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the maximum extent permitted.

12. Suspension and Termination

We may suspend or terminate your access immediately if you violate these Terms, present a security risk, or as required by law. You may stop using the Service at any time. Upon termination, your right to use the Service ends, but sections that by their nature should survive will survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the European Union where applicable; where not possible, the laws of England and Wales apply.

Any dispute shall first be resolved through good-faith negotiation, then non-binding mediation in the UK. If unresolved, the courts of England and Wales shall have exclusive jurisdiction, subject to mandatory consumer protection provisions where applicable.

14. Changes to the Service or Terms

We may modify the Service or these Terms at any time. We will provide notice of material changes. Your continued use after changes become effective constitutes acceptance.
